OFFICIAL RULES: By participating, entrants agree to be bound by these Official Rules and by the decisions of the Maine Red Claws Foundation, which shall be binding and final as to all matters related to the Raffle.  The Raffle is subject to all applicable federal, state, and local laws. 

LICENSEE:  This Raffle is conducted by the Maine Red Claws Foundation, 413 Congress Street, Portland, ME 04101, pursuant to a license issued by the Maine State Police.

PRIZE (ONE WINNER):  One Winner will receive a 2010 model year Chevrolet Corvette Convertible having a manufacturer's suggested retail price of $65,720.00.

ELIGIBILITY TO ENTER:  Raffle tickets may be purchased by legal residents of the State of Maine who are at least 18 years of age at the time of entry.  A Raffle ticket can be purchased in the name of only one individual, and may not be purchased in the name of a business, trust, corporation, or other entity.  The raffle tickets will be sold at the offices of the Maine Red Claws, 413 Congress Street, Portland, ME 04101, and at other locations that may be determined by the Maine Red Claws Foundation in its sole discretion.  The Raffle is void where prohibited by law.

PURCHASING RAFFLE TICKETS:  The price of each raffle ticket is $100.00.  No discounts or complementary tickets will be given.  Raffle tickets will be available for purchase in person by eligible persons (see "ELIGIBILITY TO ENTER" above).  Official Rules are available at the offices of the Maine Red Claws, 413 Congress Street, Portland, ME 04101, at www.july4thportland.org, and at various locations in Maine at which the Corvette shall be displayed, and should be read before ticket purchase.  All raffle ticket sales are final.

RAFFLE TICKETS ARE NONDEDUCTIBLE: No portion of the raffle ticket price may be deducted as a charitable contribution for federal income tax purposes.

ODDS:  Each raffle ticket is separate and has an equal chance of winning.  The odds of winning depend on the number of valid raffle tickets sold.  A maximum of 1,000 raffle tickets will be sold.

RAFFLE ENTRIES NOT TRANSFERABLE:  Purchasers of raffle tickets may not resell or otherwise transfer their raffle tickets.  Raffle tickets that have been resold or transferred in violation of these Official Rules shall be void.

DRAWING:  The Winner will be selected in a random drawing from all eligible entries.  The drawing will be held at 5:00 p.m. on September 15, 2011 at the offices of the Maine Red Claws, 413 Congress Street, Portland, ME 04101.  If for any reason whatsoever the drawing cannot be held at that time, it will be held within a reasonable time thereafter.  The drawing is open to the public, but the Winner does not need to be present to win.

NOTIFICATION OF WINNER:  The Winner will be notified by the Maine Red Claws Foundation by telephone and certified mail in accordance with the contract information supplied on the raffle ticket.

CLAIMING THE PRIZE:  The prize must be claimed in person at Quirk Chevrolet, 1000 Brighton Avenue, Portland, ME 04102, within fourteen (14) days of notification.  Failure to claim a prize within the required time period may result in disqualification.  In the event the Winner declines the prize, fails to return the completed Winner Documents (see "GENERAL CONDITIONS" below), or fails to claim the Prize within the required time period, or is found to be ineligible or not in compliance with these Official Rules, the Maine Red Claws Foundation will select an alternate winner by random drawing from the entries.

TAXES AND OTHER EXPENSES:  All taxes, expenses, and other obligations on the prize are the sole responsibility of the Winner.  The Winner will be solely responsible for license, registration, title, fees, sales tax, insurance, and all other expenses on the receipt and use of the Prize.  The Maine Red Claws Foundation will file a Form 1099 with the Internal Revenue Service to report the value of the Prize.  The Winner will also receive a copy of the Form 1099. 

GENERAL CONDITIONS:  Prizes are not transferable, assignable, or redeemable for cash. 

Any violation of these Official Rules or any attempt to win the Raffle by fraud, or other deceptive means will result in the immediate disqualification of the entrant(s) from this Raffle.  In the event the Raffle is, in the sole opinion of the Maine Red Claws Foundation, compromised by any cause which corrupts or impairs the administration, security, fairness, or proper play of the Raffle, the Maine Red Claws Foundation reserves the right, in its sole discretion, to select the Winner from eligible, non-suspect entries as deemed fair and appropriate by the Maine Red Claws Foundation. 

 

The Winner, by accepting the prize, grants permission (and agrees to confirmation that grant in writing) to the Maine Red Claws Foundation the right to use his or her name, city/town of residence, photograph, likeness, image, voice, and biographical information for advertising, trade, publicity, and/or promotional purposes without further notice, permission, or compensation.  The Winner will be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (the "Winner Documents"), which must be executed and returned to the Sponsor within fourteen (14) days of notification.  Failure to comply with these requirements within this time period may result in disqualification. 

 

RELEASE OF LIABILITY:  By accepting the prize, the Winner releases the Maine Red Claws Foundation, Quirk Acquisition Co., d/b/a Quirk Chevrolet, Maine Basketball, LLC, Maine Today Media, Inc., and Wright Express Corporation, and their subsidiaries, affiliates, employees, and agents from any and all liability for any loss, harm, damages, costs or expenses, of any kind, including and without limitation property damages, personal injury and/or death, arising out of or resulting in whole or in part, directly or indirectly, from participation in this promotion or promotion-related activities or from the acceptance, use, or misuse of the Prize. 

 

TRADEMARKS:  All trademarks are the property of their respective owners, and may not be used except with the express authorization of the trademark owners.

 

CANCELLATION:  The Maine Red Claws Foundation reserves the right to cancel this Raffle at any time, in which event its liability is limited to refund the ticket prices to the participants.

 

GOVERNING LAW:  The Raffle and these Official Rules shall be subject to and governed by the laws of the State of Maine.
